These Terms & Conditions (“Terms”) explain your rights and responsibilities when you use tapsy.app, our mobile applications, and any related services (collectively, the “Platform”).
By creating an account, posting a review, or simply visiting the Platform, you agree to these Terms and to our [Privacy Policy]. If you don’t agree, please don’t use Tapsy.
• Age Requirements: You must be at least 13 years old (or the minimum age of digital consent in your country) to use Tapsy. If you are under 18, you confirm that you have parental or guardian permission.
• Account Details: When you create an account, you agree to provide accurate information and to keep it updated. You are responsible for keeping your password secure and for all activity under your account.
• Business Accounts: Businesses claiming a profile must have the authority to represent that business.
Tapsy lets you upload and share video reviews, comments, and other material (“Content”).
You keep ownership of everything you create, but you give Tapsy a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:
• host, store, display, reproduce, distribute, and share your Content on the Platform and through our social media channels,
• promote and improve Tapsy’s services, and
• allow other users to view and share your Content within the Platform.
This license ends when you delete your Content or account, except where:
• copies have been shared by others, or
• Tapsy needs to retain content for legal, security, or backup purposes.
By posting Content, you represent and warrant that:
• you own the rights to the Content or have permission to use it,
• it does not infringe anyone’s copyright, trademark, privacy, or publicity rights, and
• it complies with these Terms.
You agree not to:
• post Content that is unlawful, defamatory, hateful, harassing, pornographic, violent, or otherwise harmful,
• upload viruses, malicious code, or attempt to hack or disrupt the Platform,
• impersonate anyone or misrepresent your affiliation,
• spam, solicit, or engage in deceptive reviews (including fake or paid reviews without disclosure),
• use automated tools (bots, scrapers) without our written permission.
Tapsy may remove or restrict any Content that violates these rules.
• We’re always improving Tapsy, and we reserve the right to:
• suspend or terminate accounts that violate these Terms,
• remove or edit Content that we believe violates the law or our policies,
• modify, update, or discontinue any part of the Platform at any time, with or without notice.
• Our Rights: All trademarks, logos, designs, software, and other materials created by Tapsy are our exclusive property and protected by intellectual property laws. You may not use them without our written consent.
• Your Rights: Except for the license granted to Tapsy, you retain all rights in your original Content.
• No Guarantees: Tapsy provides the Platform “as is” and “as available.” We make no warranties about the accuracy of reviews, uninterrupted service, or that the Platform will be free of errors or harmful components.
• User Responsibility: Reviews are opinions of individual users. Tapsy does not endorse or verify the truth of any Content.
• Limitation of Liability: To the fullest extent allowed by law, Tapsy and its affiliates are not liable for any indirect, incidental, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Platform.
Some jurisdictions do not allow certain exclusions of liability, so these limitations may not apply to you.
Tapsy may contain links to third-party websites, apps, or services. We are not responsible for their content, privacy practices, or terms. Use them at your own risk.
• If you are a resident of the United States, the laws of the State of California will apply, excluding conflict-of-law principles.
• For other countries, local consumer laws may also apply.
• We encourage informal resolution first. If a dispute cannot be resolved informally, it will be settled through binding arbitration or small-claims court, where allowed.
We may update these Terms from time to time. If the changes are material, we’ll notify you by email or on the Platform. The updated Terms will be effective when posted.
